An Update About Jonathan's Case

On Tuesday May 7th, we (Jonathan's Family) accompanied Jonathan to court. He was before Judge Bargnesi in section 10 of the court house.

When Jonathan walked into the court room it was heart breaking. Not only has he been wrongfully incarcerated for the past 25 years, seeing him in that green jum

p sit with chains on his wrist, waist and feet seemed to conjure up ancestral pain. I couldn't help but to think this must be what our ancestors went through.


I guess it was bitter sweet. Many of our family and friends haven't seen him in 25 years. He looked strong, healthy, but sad. I guess any of us would be if we were chained for 25 years.


The prosecutors argued all the reason they didn't think Jonathan deserved an evidentiary hearing. Of course his attorney, Steve Metcalf and Bob Goldstien stated why he did. Both sides did the best they could.

The prosecutors did admit that one of the witnesses was promised a favorable outcome if he testified against Jonathan in this murder trial. That was a Brady violation, but none of this matters if the Judge doesn't deem it necessary to give Jonathan's case and the new evidence a second thought.

At this point, we have committed to taking turns fasting, and collectively praying


for Jonathan's release and for Justice to be given to everyone, including the slain officer.


Jonathan did not have a fair trial. The witnesses testimony was all made up, and the only question I have is WHY?!!? What the hell are they hiding. Who really killed Officer McDougald? Jonathan sure didn't.



Judge Bargnesi said that we would have a written decision as to if he believes an innocent man deserves to have the evidence that may free him heard in open court. We really don't know. He didn't sound like he was a fan while in court (videos will be posted on instagram and twitter later today). We know that he is at heart a prosecutor, and that he and his family are close friends with DA Flynn. We just hope and pray that he will just look at the case from an unbiased view so that justice can really be served.
