Back in 1997 Buffalo Police Officer Charles McDougal was shot to death on Northamption and East Parade. His partner was shot and wounded.. The partner described the shooter as “light skinned”. Desperate to find this “cop killer”, the Homicide Detectives scoured the streets. They were looking for anything or anyone to justify the arrest of this most despised by the authorities of all criminals, a “cop killer”
There was a teenager in the neighborhood that the cops suspected was involved in some criminal activities. His name was Jonathan Parker. His street name was “Face”. Although they had no evidence whatsoever that Jonathan was the “cop killer”, and despite the fact that he was “dark skinned”, the Detectives had to come up with a shooter quickly since the Press was hounding them on it. So they decided to frame Jonathan Parker for Officer McDougal’s murder. To prevent any “street” retaliation, Jonathan Parker’s lawyer surrendered him to the Police Station..
They had no witnesses. They had no evidence. So they had to create some. A truck had passed the Northhamption-East Parade intersection just as the police car was turning right off East Parade onto Northhampton. The driver had two passengers, a married couple. The man was facing prison for federal drug crimes. Even though the truck was already down at the red light on Filmore, the authorities got the man and his wife to lie and say they were still at the East Parade stop sign when the shooting took place. They testified that they had seen the entire encounter and that the shooter was the teenager, Jonathan Parker. The actual driver, who obviously would not lie for the authorities, was never called to testify. Why would this couple lie and effectively frame an innocent man? Because instead of serving three years in a federal penitentiary, the man’s sentence for his federal drug crimes was arranged to be six months home confinement. The authorities recruited another supposed eye witness. Homicide Detective Andre Ortiz threatened to take one man out in the county and blow his head off if he did not lie and say he saw
Jonathan Parker do the shooting. Some might say that a cop would never do such a thing. But this cop, Andre Ortiz, was subsequently arrested for some “sealed by the court’ crimes, and pled guilty to providing secret police information to street criminals. So it is quite apparent that this cop, Andre Ortiz ,was definitely capable of doing something like that, and indeed DID do something like that. He is now a convicted criminal for committing such nefarious crimes while serving as a Buffalo Police Detective.
Officer McDougal’s wounded partner, who was the closest to the shooter, and who had stated that the shooter was a light-skinned male, at the trial, would not positively identify dark-skinned Jonathan Parker as the person who had killed Officer McDougal, and who had also shot him.
Fortunately, both these supposed eye witnesses have since come forward to tell the truth. The one Detective Ortiz threatened to kill said he is no longer afraid of being shot since Ortiz is no longer a cop. The other one, after having served his reward for testifying falsely, six months at home instead of three years in a federal penitentiary, now wants to clear his conscience and tell the truth. The truth is that he allowed the authorities to use him and his wife to frame a totally innocent man, Jonathan Parker, for the murder of Police Officer Charles McDougal, a murder which Jonathan Parker definitely did NOT commit. Jonathan Parker’s Defense Team filed an motion to vacate his judgement of conviction in Erie County Supreme Court. On a regular basis the courts are vacating wrongfully convicted individuals and releasing them from their wrongful imprisonment. Since the filing of the motion to vacate Jonathan Parker’s wrongful conviction the Erie County District Attorney’s office has requested, and been granted, multiple adjournments. The Defense Team was finally able to argue in open court for an Evidentiary Hearing to be granted in this matter. At that oral argument new issues arose which require supplemental responses and briefs from the parties. We are now in the process of investigating and drafting our responses. The purpose of this supplemental briefing is to further establish cause as to why an Evidentiary should be granted. At that hearing the defense team would be able to produce witnesses to establish of Mr. Parker’s innocence. They will have the opportunity to come forth, to testify under oath, and to be cross-examined, so that the truth, the whole truth, and nothing but the truth might be finally revealed.
Originally the Assistant District Attorney agreed to having a hearing. We submit that when his “bosses” found out that something might come out at a hearing that could reverse a twenty-five year old conviction, they took him off the case and demoted him. He no longer works for the District Attorney. The new Assistant District Attorneys assigned to this case quickly filed a new Opposi
tion. Now the Prosecution is strongly opposing any such hearing. They have clearly stated they do not want any kind of Evidentiary Hearing. We submit that they do not want a hearing where the actual truth of how Jonathan Parker was framed for Officer McDougal’s murder would be revealed to the public. Jonathan Parker, and indeed all of society, deserve to have this Evidentiary Hearing, to have the truth of this wrongful conviction finally revealed.
